As soon as you are arrested, you have the right to know the reason for your arrest, be considered innocent, and remain silent. You are also entitled to be represented by an attorney. If you’re a foreign national, you can request to be assisted by a translator and call your consulate to receive assistance.

After booking, you also have the right to contact a friend or relative of your choice. The prosecutor has up to 48 hours to release you or take you to the judge.

In order to avoid criminal charges and obtain an immediate release, your attorney has to be involved in the pre-investigation process from the very beginning. This is why is very important to hire a competent and experienced criminal defense attorney.

Most serious offenses, for example, carrying certain firearms or ammunition, voluntary homicide, most sex crimes, most drug-related crimes, and kidnapping, are not eligible for bail in Mexico.

Moreover, the prosecutor may request the judge to order Pre-trial detention for less serious crimes when there is justifiable cause to believe that the defendant is likely to flee the country/state/area to avoid criminal prosecution.
