Federal authorities, districts, and states in Mexico <a href=\"#:~:text=%20because%20the%20new%20system%20required%20updating%20many%20of%20the%20country%E2%80%99s%20laws%20and%20institutions%20and%20changing%20the%20entrenched%20practices%20of%20justice%20system%20officials%2C%20mexico%E2%80%99s%2031%20states%2C%20fe\"><u>were given eight years to adapt to the new criminal justice system<\/u><\/a>\u00a0because it marked a substantial overhaul of the country\u2019s laws and judicial practices. But what are the main differences between Mexico\u2019s old and new criminal justice systems? And how has the system evolved since the inception of the adversarial system?<\/p>\n<p>Here&#8217;s a detailed breakdown of how Mexico\u2019s criminal justice system has evolved since 2008.<\/p>\n<h2><strong><b>The Old Criminal Justice System<\/b><\/strong><\/h2>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\"aligncenter wp-image-3238 size-full\" src=\"https:\/\/www.meneseslegal.com\/wp-content\/uploads\/2022\/07\/scale-gavel.png\" alt=\"A scale and a gavel on a desk\" width=\"515\" height=\"750\" \/><\/p>\n<h3>How Did it Function?<\/h3>\n<p>Mexico\u2019s previous criminal justice system was largely <a href=\"https:\/\/www.britannica.com\/topic\/inquisitorial-procedure\"><u>inquisitorial<\/u><\/a>. This meant that the judge was responsible for organizing and analyzing written evidence put forward by the prosecution and defense in court. Oral testimonies were rarely cross-examined, and it was common for defendants to be incarcerated immediately after being arrested without evidence. Moreover, defendants were rarely given the chance to exercise their right to legal counsel.<\/p>\n<p>The old criminal justice system in Mexico gave rise to numerous cases of corruption and <a href=\"https:\/\/www.law.cornell.edu\/wex\/due_process\"><u>due process<\/u><\/a>\u00a0violations. Legal proceedings were slow due to the abundance of <a href=\"http:\/\/springer.iq-technikum.de\/referenceworkentry\/10.1007\/978-3-319-31816-5_3517-1\"><u>red tape<\/u><\/a>\u00a0and sentences were given out without debate. In some instances, judges handed their responsibilities to their secretaries which enabled prosecutors to dominate court proceedings regularly.<\/p>\n<h2>The Prosecution Dominated Court Proceedings<\/h2>\n<p>Have you heard of the term \u201cinnocent until proven guilty?\u201d <a href=\"https:\/\/www.law.cornell.edu\/wex\/presumption_of_innocence\"><u>This is a legal principle known as the presumption of innocence<\/u><\/a>\u00a0and was endorsed under Mexico\u2019s old criminal justice system. Yet the old system operated in such a way that defendants were more often treated as \u201cguilty until proven innocent\u201d instead! In simpler words, prosecutors had far more control over court proceedings than defense lawyers under Mexico\u2019s old criminal justice system.<\/p>\n<p>The old criminal justice system in Mexico <a href=\"#:~:text=without%20the%20judge%E2%80%99s%20oversight%2C%20prosecutors%20were%20able%20to%20utilize%20fake%20testimonies%20and%20evidence.\"><u>made it easy for prosecutors to fabricate testimonies<\/u><\/a>\u00a0and plant evidence to rack up convictions. Additionally, defendants were rarely given the chance to participate in court hearings as they were placed in holding cells separate from the judge and attorneys. While it was legal for a defendant\u2019s family and friends to attend the hearing under the old system, court proceedings took place in offices as opposed to actual courts. This meant that any party in support of a defendant had to sit far away and couldn\u2019t offer their support. All these factors gave prosecutors far more power than defendants during trials under Mexico\u2019s old criminal justice system.<\/p>\n<h3>The Police Had a Predominantly Correctional Role<\/h3>\n<p><img decoding=\"async\" class=\"aligncenter wp-image-3240 size-full\" src=\"https:\/\/www.meneseslegal.com\/wp-content\/uploads\/2022\/07\/police-officers.png\" alt=\"Police officers in Mexico\" width=\"1000\" height=\"1333\" \/><\/p>\n<p>Imagine living in a country where the police don\u2019t do any investigative work. That\u2019s what Mexico was like before 2008! The role of the police in Mexico\u2019s old criminal justice system was corrective as opposed to investigative. In other words, the police were primarily tasked with making arrests, transporting convicts, and imposing orders instead of uncovering evidence and contributing to court proceedings. They were also used by powerful people such as political figures to coerce people into doing their bidding.<\/p>\n<p>Unfortunately, the police\u2019s limited role under Mexico\u2019s previous criminal justice system meant they rarely received training and equipment on how to carry out investigative tasks. This made them susceptible to numerous unethical practices including corruption, bribery, and a willingness to use violent torture techniques during interrogations. Before the introduction of <a href=\"#:~:text=merida%20programs%20and%20activities\"><u>programs like the Merida Initiative<\/u><\/a>, the police were also severely underfunded.<\/p>\n<p>It was also common for police officers to put defendants into prisons full of convicts while waiting for the outcome of trials. In other words, countless innocent people were being detained by the police without evidence under the old criminal justice system. Unfortunately, hearings were often prolonged because the written affidavits submitted to the judge under the old criminal justice system were lengthy, unreliable, and disorganized. The prosecution had no problem waiting for judges to go through these documents. However, the defendants paid a steep price as they faced lengthy pre-trial incarcerations while judges went through the process of organizing, reading, and analyzing the affidavits.<\/p>\n<h3>Coerced Confessions Were Prevalent<\/h3>\n<p>If you ask the average joe what they think about coerced confessions, chances are they\u2019ll tell you it\u2019s unethical. Police are now trained to conduct investigative tasks and play a much bigger role in the delivery of justice than before.
